An Update on the Expanded Maternity Leave Bill

The Expanded Maternity Leave Act of 2017 is undoubtedly one of the pending bills closest to every mother’s heart. Following the report that Mommy Mundo made on its approval by the Senate, we received numerous inquiries from our community, some of whom were pregnant moms, about the status of the bill.
Mommy Mundo reached out to the office of Senator Risa Hontiveros, the author of the bill, and we received this reply:

“Magandang araw, hindi pa po tapos ang laban sa Expanded Maternity Bill, bagaman ito ay pasado na rito sa Senado, kailangan pa rin magsumite ang House of Representatives ng kanilang version na ngayon ay nasa 2nd reading pa lang. Kapag po may version na ang House of Representatives, isasalang na po ito sa Bicameral Conference para salain at pag-isahin ang dalawang version. Saka pa lang ito isusumite sa pangulo para pirmahan.”

[“Good day, the fight for the Expanded Maternity bill is not yet over. Though it has been approved by the Senate, the House of Representatives still needs to submit its version which is just on its second reading. When the House of Representatives has its version, the bill will go through the Bicameral Conference for screening and for integration of the two versions. Only then will it be submitted to the president for signing.”]

The counterpart bill of the House of Representatives calls for increasing the maternity leave period to one hundred (100) days for female workers in the government service and in the private sector, and granting an option to extend for an additional thirty (30) days without pay.

According to Congress records, the bill is labeled as “Unfinished Business” and in the “Period of Interpellation.”

          akala ko din implemented na to dpa pala, August na due date ko, so its means hindi pa to permado by the time na manganak ako, how sad, i was expecting na makakaavail na ako lalo na at CS pa naman ako.

            Same feeling here mommies, due on September and I was too happy when I read about this months ago. Only to find out na hindi pala pala. Sad to say, ito na ang huling baby ko at hindi na pala mararamdaman ito. 🙁

      Unfortunately, we do not know when this will be enacted into law. As stated, the version of the House of Representatives has still to be approved, so the bill still has a long way to go before it is presented to the president for approval and signing. Thank you!

    Hi Mommy Mundo, can i ask ilang readings need ng Hosue of Representative?. Bago magkaron ng bicameral COnference?. Hoping sana maapprove ito as soon as possible. Due ko sa OCt. umaasa padin ako. Malaking bagay kasi to sa mg aworking mommies,. Most of us, napipilitan magresign dahil kulang talaga ang two months para itake care at magpalakas. lalo na if may problem sa breastfeeding.

    MANILA, Philippines – The Senate on Monday, March 6, approved on 3rd and final reading the bill seeking to grant 120 days of maternity leave to expectant mothers.
    With a vote of 22-0, Senate Bill 1305 or the “Expanded Maternity Leave Law of 2017” was passed. Senator Risa Hontiveros, chair of the Senate committee on women, children, family relations, and gender equality, authored the measure.

    Under the bill, all female workers, regardless of civil status or legitimacy of her child, shall be granted 120 days maternity leave with pay and an option to extend it for another 30 days without pay. Under the current law, expectant mothers are allowed only 60 days of paid leave.

    everytime, i browse for an update regarding this bill… i thought maaabutan ko .. october this year ako manganganak pero tingin ko malabo ng maging law yan this yr. baka 3-5 yrs pa yan. kaya mga mommies, wag na tayong umasa dahil alam naman na natin na ganito talaga ang gobyerno natin. this is philippines.. para namang hindi tayo sanay

    magandang araw po…tanong ko lang po hal. lang ako ay pregnant, employed po ako, tapos sa 60 days na maternity leave ko sinasahuran ako, ang tanong ko pag nag file po ba ako ng maternity sa SSS sa akin pa rin po ba mapupunta ? saka hindi po ako na ka pag cash advance?

          It states: “For employed members, the benefit is advanced by the employer to the qualified employee, in full, within 30 days from the date of filing of the maternity leave application. The SSS, in turn, shall immediately reimburse the employer 100 percent of the amount of maternity benefit advanced to the female employee upon receipt of satisfactory proof of such payment and legality thereof.”

    Is there an update on this? Andami kasing lumalabas sa newsfeed ko na approved na daw but when I check the news link, it’s still the manila bulletin post last march 6. Nacoconfuse tuloy ang mga mommies.

    hi dear,may i know also if this will also cover up to how many pregnancies? currently the maternity only covers up to fourth pregnancy only but I’ve read that all pregnancy will be paid with this new law. im currently on my fifth pregnancy , and their twins. im anxious to know if i will get paid or not. thank you

      The House has still to pass their own version of the law. After that, the House and the Senate shall meet to combine the two versions. So until they come up with their combined version, we don’t know what the specific details are of the law yet.

    Hi ma’am, since it is obvious that i could not avail that 120 days maternity leave. I just like to ask clarification about the 60 days maternity leave. How to interpret that 60 days? Is it 60 calendar days or 60 working days? Because when we say of 60 calendar days, holidays and weekends are counted. But when we say 60 workings days it is a total of 12 weeks which is longer that the calendar days. Thank you

    Hi! Wala pa rin po bang balita about sa 120 na maternity leave? Sana naman ngayong August maging okay na. Maraming mga ina ang naghihintay para dyan. Tulad ko 3rd week ng September ako manganganak. Sana po maihabol nyo na. Importante po ito sa mga magiging ina. Sana mapakinggan ang aming hiling.

    I am also hoping for this.. I initially thought implemented na ang 120days leave hindi pa pala to passed into law. Sobrang tagal na nito, bill pa rin until now, nauna pang maipasa yung mga bagong bill. Gusto kong umasa na bago ko magdue sa Dec passed into law na to kaso mukang di advisable. Can anyone or the author of this article make way para maiparating to kay President? I think he will make way for this, since womens health advocate din partner nya maiintindihan nya needs nating mga mommies. And kung tutuusin dapat lang maipasa na to kasi susunod lang naman tayo sa nararapat na maternity standards diba.

    Hello poh.,Hoping and praying parin po ako na sana before my due ay ma ipasa na po ito as LAW. Para sa working mom na tulad ko ay hindi pa rin sapat yung 120 days pero malaking ginhawa na po ito kumpara sa kasalukuyang 60 days leave.     Kung kayo ne t year pa ang due ako October 2017 na so mas lalong di na ako aasa kasi wala pa palang malinaw na patutunguhan ang bill na ito. Sana one of the priorities ito ng government since mga mother ang unang magpapasalamat at matutuwa dahil mas may time sila na maalagaan ang bagong silang na anak for 120 daya before iwan ulit at bumalik sa trabaho…

    Hi po. Good afternoon. Ask ko lang po sa mga mommies na naka-avail na ng Maternity Benefits,taxable po ba yung amount na makukuha? Yung saken kasi hindi in-advance ng company,parang sumasahod lang ako while on leave,tapos binawasan pa ng tax. 🙁

Mocs Javier is a mom of 4, an educator, coach, and Mocs Javier is a mom of 4, an educator, coach, and lifelong learner with a deep commitment to helping children, families, and educators thrive. With over 20 years in progressive education, she now serves as Literacy Coordinator at Keys School Manila, supporting teachers in creating meaningful and effective learning experiences. She is also a certified parent coach, working closely with families to strengthen connection and compassion at home. 

Beyond the classroom, Mocs supports nonprofit organizations in developing their education arms and programs. She has led various roles in education and cultural enrichment, including founding Camp Adobo, the first Filipino children’s cultural camp.
